This Privacy Notice (the “Notice”) describes the privacy practices of ASBC Inc. (“ASBC,” “we,” “us,” or “our”). It applies to personal information we collect about you when you use our website or mobile applications, interact with us on social media other digital channels, and when you otherwise interact with us offline (collectively, our “Services”). The Notice describes the personal information we collect, how we use and disclose personal information, how we protect it, and your choices relating to your personal information.

By using our Services or otherwise providing personal information to us, you agree to our Terms of Use and our privacy practices as described in this Notice.

How We Collect and Use Personal Information

“Personal Information” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you. Personal Information does not include information that is publicly available, de-identified, or aggregated.

The following chart describes the categories of Personal Information we collect and the purposes for which we collected this information. Depending on your relationship with us, we may not collect all of this information about you. For example, we collect different types of Personal Information about consumers and business contacts. Other Uses.

We may also collect, use, and disclose Personal Information as required by law, regulation or court order; to respond to governmental and/or law enforcement requests; to identify, investigate, contact or bring legal action against someone who may be causing injury to or interfering with our (or others’) rights or property; to support any actual or threatened claim, defense or declaration in a case or before any jurisdictional and/or administrative authority, arbitration or mediation panel; or for other purposes described in any other privacy notice or with your consent. Additionally, we may use and disclose Personal Information to third parties in connection with a sale, assignment, merger, reorganization, or other corporate transaction relating to all or part of our business.

Sources from Which We Collect Personal Information

Generally, we collect the categories of Personal Information described above from the following categories of sources:

  • Directly from you
  • From affiliates and related companies
  • Through tracking technologies we use on our electronic Services
  • From service providers that help us to operate our business (e.g., vendors that provide communications, market research, analytics, customer support, and other services)
  • From third parties such as data analytics providers, advertising networks, social networks, internet service providers, partner businesses, and third parties from which we may license or purchase data
  • Created by us (e.g., drawing inferences from the other categories of Personal Information we collect or assigning a username or email address to an employee)

Cookies and Other Tracking Technologies

We use cookies, pixels, software development kits, and other similar technologies (collectively, “Tracking Technologies”) to collect and store information about your interactions with our website, including information about your browsing behavior. In general, we use Tracking Technologies as follows:

  • When necessary to operate our Services (for example, for security purposes)
  • To enhance the user experience, including by personalizing content for you or remembering your preferences (e.g., your choice of language or location)
  • For analytical purposes, including to help us understand how our website is used, to see what products most interest you, and to determine how best to market our products to you
  • For advertising and marketing. These Tracking Technologies collect information about your use of our Services to show you relevant advertisements when you visit other websites or use social media

Our Services use first-party Tracking Technologies as well as Tracking Technologies supported by our service providers and third parties, such as advertising partners. Here are more details on some of the main Tracking Technologies we use:

Cookies: Cookies are small text files that a website server stores on your computer or device. The length of time a cookie will stay on your device depends on whether it is a “session” or “persistent” cookie. Session cookies generally stay on your device until you stop browsing. Persistent cookies stay on your device until they expire or are deleted. We use both session cookies and persistent cookies on our website. Many browsers allow you to adjust your settings to refuse cookies before accessing our website. Pixels/Beacons: Tracking pixels (also known as web beacons) are tiny graphics embedded invisibly on a webpage that may be used to deliver or communicate with cookies, to count users who visit certain pages, and to understand usage patterns. We use pixels on our website to count how many users visit certain pages or take certain actions to collect or receive information from our website and elsewhere on the Internet. We may use this information to improve our marketing programs and content, and target advertisements on our Services and on third-party services. Our email messages may also contain pixels used for similar purposes.

Analytics: These services may use cookies and other Tracking Technologies to help us analyze how you use our Services. Information collected or generated by analytics Tracking Technologies (e.g., your IP address and other usage information) may be transmitted to and used by these service providers for purposes such as evaluating your use of the Services and compiling statistics about activity on the Services, among other uses. This helps us understand how you use our Services so that we can improve the user experience and better tailor our marketing and promotions.

Targeted Advertising: We may contract with vendors to collect information about your browsing activity over time and across other websites, including via Tracking Technologies. These companies use the information they collect to serve ads that are targeted to your interests when you browse the internet or use social media. Some of the publishers and vendors that support our advertising may participate in the Digital Advertising Alliance (“DAA”) AdChoices Program and may display the YourAdChoices Icon for Interest-based Ads that links to an opt-out tool which allows you to make certain choices regarding ad targeting. In addition, certain advertising networks and exchanges may participate in the Network Advertising Initiative (“NAI”). Do Not Track Signals: Our website does not respond to “Do Not Track” signals at this time.

Our Retention of Personal Information

We keep the categories of Personal Information described above for as long as is necessary for the purposes described in this Notice or otherwise authorized by law. This generally means holding the information for as long as one of the following apply:

  • Your Personal Information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the information;
  • Your Personal Information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the Personal Information was collected;
  • The Personal Information is reasonably necessary to protect or defend our rights or property (which will generally relate to applicable laws that limit actions in a particular case); or
  • We are otherwise required or permitted to keep your Personal Information by applicable laws or regulations.

Where information is used for more than one purpose, we will retain it until the purpose with the latest period expires.

How We Disclose Personal Information

Disclosures for Business Purposes:

Generally, we may disclose any of the categories of Personal Information we collect to our service providers and contractors for the following business purposes:

  • Performing services (including processing, maintaining, or collecting Personal Information) on our behalf related to the operation of our business and/or the Services (e.g., fulfilling and delivering orders, processing payments, supporting our marketing, promotions, contests, and providing communications, technical, analytical, web hosting, cloud hosting, or other services that help us further the purposes for which we collect each category of Personal Information)
  • related to ad impressions
  • Ensuring security and integrity of Personal Information
  • Debugging to identify and repair errors that impair existing intended functionality
  • Short-term, transient use, including, but not limited to, non-personalized advertising
  • Providing advertising or marketing services on our behalf (except for cross-context behavioral advertising)

  • Detecting, protecting against, or addressing malicious, deceptive, fraudulent, or illegal activity

Transfers of Personal Information to our Affiliates:

We may disclose your Personal Information to ASBC affiliates.

Targeted Advertising, Sales, and Sharing of Personal Information:

Although we do not sell Personal Information in exchange for money, some of the ways in which we share Personal Information for advertising, marketing, or analytics may be considered “sales” or “sharing” under some US state privacy laws. Listed below are the categories of Personal Information we share for purposes of targeted/cross-context behavioral advertising or otherwise “sell” for non-monetary consideration:

  • Identifiers
  • Personal records
  • Commercial information
  • Internet or other electronic network activity information
  • Geolocation data
  • Inferences

The types of third parties to which Personal Information is sold or shared are third-party advertisers and some analytics vendors. The purposes for which we sell/share this information include showing you relevant ads while you browse the internet or use social media; improving your user experience on our website; marketing, advertising, certain types of analytics, or similar purposes. We may also share Personal Information with promotional partners—such as designers and other retailers for cross-promotional purposes—and with Bang & Olufsen. We do not have actual knowledge that we sell or share the Personal Information of consumers under 16 years of age. Other Disclosures of Personal Information:

We may disclose your Personal Information to third parties, including governmental authorities, to comply with any applicable law, regulation, legal process, or enforceable governmental request or if we believe in good faith that such disclosure is necessary to protect against harm to the rights, property or safety of ASBC Inc, our customers, or the public as required or permitted by law. We may also disclose Personal Information to evaluate or conduct a merger, sale, or other disposition of some or all of our assets.

Your Choices

Opting Out of Targeted Advertising, Sales, and Sharing of Personal Information:

In accordance with applicable state privacy laws, we provide the right to opt out of targeted advertising, sales, and sharing of your Personal Information. If you would like to opt out of targeted advertising, sales, and sharing via Tracking Technologies, please scroll down to the bottom of the page and click on the “Do Not Sell or Share My Personal Information” link.

Consumers in some states, such as California, Nebraska and Texas, may also use the Global Privacy Control signal to opt out. If you choose to use a browser-based opt-out signal, you will be opted out of targeted advertising, sales, and sharing through Tracking Technologies, and will need to turn it on for each browser you use. Changing or Updating Your Personal Information:

Please note that if you opt-out of our promotional emails, we may still send you email messages related to your account or any Services you request from us. Unsubscribing from our promotional emails will not affect the level or quality of service we provide to you.

State-Specific Privacy Rights

You may have additional privacy rights under the law of the state in which you live. This includes the rights of California residents as well as consumers in Nebraska, Nevada, and Texas, (collectively “Covered States”).

To exercise your privacy rights, please submit a request through our webform. Please note that we may need to authenticate your identity before your request can be processed. For authentication, you will be asked to provide 2-3 pieces of Personal Information that we will match against our records. In some states and for some types of requests, you may designate an authorized agent to make a request on your behalf; however, you will still need to verify your identity directly with us before your request can be processed. An authorized agent may submit a request on your behalf using the webform or toll-free number listed above. We will not discriminate or retaliate against you if you choose to exercise any of your privacy rights under the Covered State privacy laws.

California

Right to Know: You have the right to know what Personal Information we have collected about you, which includes:

  • The categories of Personal Information we have collected about you, including:
  • The categories of sources from which the Personal Information was collected
  • Our business or commercial purposes for collecting, selling, or sharing Personal Information
  • The categories of third parties to which we disclose Personal Information
  • The categories of Personal Information that we sold or shared about you, and for each category identified, the categories of third parties to which we sold or shared that particular category of Personal Information
  • The categories of Personal Information that we disclosed for a business purpose, and for each category identified, the categories of service providers or contractors to which we disclosed that particular category of Personal Information
  • The specific pieces of Personal Information we have collected about you

Right to Delete Your Personal Information: You have the right to request that we delete Personal Information we collected from you, subject to certain exceptions. Where we use deidentification to satisfy a deletion request, we commit to maintaining and using the information in deidentified form and will not to attempt to reidentify the information.

Right to Correct Inaccurate Information: If you believe that Personal Information we maintain about you is inaccurate, you have the right to request that we correct that information.

Right to Opt Out of Sales and Sharing of Personal Information: You have the right to opt out of the sale of your Personal Information, and to request that we do not share your Personal Information for cross-context behavioral advertising. Texas and Nebraska

Right to Access and Data Portability: You have the right to confirm whether we are processing your Personal Information, to access your Personal Information, and to obtain a copy of certain Personal Information in a portable format.

Right to Delete: You have the right to request that we delete your Personal Information, subject to certain exceptions. Where we use deidentification to satisfy a deletion request, we commit to maintaining and using the information in deidentified form and will not attempt to reidentify the information.

Right to Correct: You have the right to request that we correct inaccuracies in your Personal Information, taking into account the nature of the Personal Information and our purposes for processing it.

Right to Opt Out: You have the right to opt out of the following uses of your Personal Information: (a) targeted advertising; (b) the sale of Personal Information; and (c) profiling in furtherance of decisions that produce legal or similarly significant effects concerning your economic situation, health, personal preferences, interests, reliability, behavior, location, or movements. We do not sell Personal Information for money and do not profile individuals in furtherance of decisions that produce legal or similarly significant effects under applicable state privacy laws. Right to Appeal: Sometimes we are unable to process requests relating to your Personal Information, in which case, your request will be denied. If we previously denied your privacy rights request and you believe we denied it in error, you may appeal for reconsideration of your request using our webform.

Nevada

Nevada residents may opt out of the “sale” of “covered information” to third parties, including but not limited to name, address, social security number, telephone number, email address, and other information through which a person may be contacted. Our uses of your Personal Information are not sales under Nevada law. If you have any questions or if you would like to receive notice by email in the event we should engage in “sales” of Personal Information under Nevada law in the future, please contact us using the contact information provided below.

How We Safeguard Personal Information

At no cost to you, we take commercially reasonable steps to protect Personal Information from loss, misuse, unauthorized access, disclosure, alteration, and destruction. Unfortunately, no security system is 100% secure, thus, we cannot guarantee the security of the information you provide to us via the Services.

International Visitors

ASBC is an authorized seller of Bang & Olufsen products in the United States, and this website is intended solely for a US audience. If you access our Services outside the United States, please be aware that Personal Information we obtain about you may be transferred to and processed in the United States or other jurisdictions outside your own, and may be accessed by the courts, law enforcement and national security authorities in those jurisdictions. By using our Services or otherwise providing your Personal Information to us, you acknowledge and consent to the international transfer and processing of your Personal Information as described in this Notice. Please be aware that the data protection laws and regulations that apply to your Personal Information transferred to the United States or other countries may be different from the laws in your country. If you do not want your Personal Information transferred to or processed or maintained outside of the country or jurisdiction where you are located, you should not use the Services.

We reserve the right to modify this Notice at any time at our discretion. Changes to this Notice will be posted on our Services and your continued use of our Services shall be deemed your acceptance of any modified terms.
